TERMS AND CONDITIONS
1 month - 3 month or 6-Month Membership Program
1. Agreement to Terms
By enrolling in the Melina Coles Violin Academy membership program, the member (or parent/legal guardian where the member is under 18 years of age) agrees to be bound by these Terms and Conditions. This agreement constitutes a legally binding contract under the laws of the State of Queensland and the Commonwealth of Australia.
2. Term of Membership
2.1 Enrollment constitutes a fixed twelve (12) month membership commitment.
2.2 The member agrees to remain enrolled for the full twelve-month term.
3. Fees and Payment Terms
3.1 The total 1 month - 3 month or 6 month membership plan is payable via a monthly installment arrangement for either the 1- 3 or 6 monthly membership.
3.2 The installment arrangement is a payment plan for a fixed-term agreement and does not constitute a month-to-month subscription for the 3 or 6 month membership.
3.3 Payments will be automatically debited from the nominated payment method on the same date each month.
3.4 The member remains liable for the full 1- 3 or 6 monthly membership commitment payment regardless of participation level, non-attendance, or voluntary withdrawal.
4. Cancellations and Early Termination
4.1 Early termination by the member does not extinguish the obligation to pay the remaining balance of the term of either 1 - 3 or 6 month membership term.
4.2 The Melinda Coles Violin Academy may suspend or terminate access where payments are overdue or where these Terms are breached.
4.3 Nothing in this agreement excludes rights available under the Australian Consumer Law.
5. Refund Policy
5.1 Due to the digital nature of the program and immediate access to proprietary materials, payments are non-refundable.
5.2 This clause operates subject to rights and remedies available under the Australian Consumer Law, including consumer guarantees that services will be provided with due care and skill and be reasonably fit for purpose.
6. Course Access
6.1 Access to digital course materials, tools, and resources is granted for the duration of the active membership term.
6.2 Access may be suspended for overdue payments.
6.3 Continued access beyond the twelve-month term is not guaranteed unless expressly agreed in writing.
7. Live Lessons and Scheduled Sessions (If Applicable)
7.1 Live lessons or group sessions must be attended at the scheduled time.
7.2 Missed sessions are not guaranteed to be rescheduled or refunded unless otherwise stated in writing.
7.3 The Melinda Coles Violin Academy reserves the right to modify schedules, instructors, or delivery format where reasonably necessary.
8. Intellectual Property
8.1 All course content, including but not limited to videos, recordings, written materials, downloadable resources, branding, and teaching tools, is protected under the Copyright Act 1968 (Cth) and remains the exclusive property of the Melinda Coles Violin Academy.
8.2 Materials are licensed for personal, non-commercial educational use only.
8.3 Reproduction, redistribution, recording, resale, public sharing, or commercial exploitation without written consent is strictly prohibited.
9. Student Conduct
9.1 Members must participate respectfully in all lessons, live sessions, and associated community platforms.
9.2 Disruptive, abusive, or inappropriate conduct may result in suspension or termination without refund, subject to applicable law.
10. Limitation of Liability
10.1 To the maximum extent permitted by law, the academy excludes liability for indirect, incidental, or consequential loss arising from participation in the program.
10.2 Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law which cannot be excluded.
11. Force Majeure
The Melinda Coles Violin Academy shall not be liable for failure or delay in performance due to events beyond reasonable control, including but not limited to natural disasters, illness, technical failures, internet outages, or government restrictions.
12. Privacy
Personal information is collected, stored, and handled in accordance with the Privacy Act 1988 (Cth) and the academy’s published Privacy Policy.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Queensland and the Commonwealth of Australia.
Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland.
14. Course Changes
We reserve the right to modify, update, reschedule, or discontinue any course content, structure, delivery method, pricing, or availability at any time without prior notice. While reasonable efforts will be made to provide updated information where practicable, enrolment in any course does not guarantee the ongoing availability of specific content, instructors, features, or materials.
